This Terms of Use Agreement sets forth the standards of use of the Academy of Personal Training Education website. By using the personaltrainingeducation.com website you (the “Visitor”) agree to these terms and conditions. If you do not agree to the terms and conditions of this agreement, you should immediately cease all usage of this website. We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted at personaltrainingeducation.com website. Your continued use of the Service after amendments are posted constitutes an acknowledgement and acceptance of the Agreement and its modifications. Except as provided in this paragraph, this Agreement may not be amended.
1. Description of Service
Academy of Personal Training Education is providing Visitor with [information about its products and services]. Visitor must provide (1) all equipment necessary for their own Internet connection, including computer and modem and (2) provide for Visitor’s access to the Internet, and (3) pay any fees relate with such connection.
2. Disclaimer of Warranties
The site is provided by Academy of Personal Training Education on an “as is” and on an “as available” basis. To the fullest extent permitted by applicable law, Academy of Personal Training Education makes no representations or warranties of any kind, express or implied, regarding the use or the results of this web site in terms of its correctness, accuracy, reliability, or otherwise. Academy of Personal Training Education shall have no liability for any interruptions in the use of this Website. Academy of Personal Training Education disclaims all warranties with regard to the information provided, including the implied warranties of merchantability and fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, therefore the above-referenced exclusion is inapplicable.

4. Indemnification
Visitor agrees to indemnify and hold Academy of Personal Training Education, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys’ fees and costs, made by any third-party due to or arising out of Visitor’s use of the Service, the violation of this Agreement, or infringement by Visitor, or other user of the Service using Visitor’s computer, of any intellectual property or any other right of any person or entity.
5. Modifications and Interruption to Service
Academy of Personal Training Education reserves the right to modify or discontinue the Service with or without notice to the Visitor. Academy of Personal Training Education shall not be liable to Visitor or any third party should Academy of Personal Training Education exercise its right to modify or discontinue the Service. Visitor acknowledges and accepts that Academy of Personal Training Education does not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances outside of our control.

Our website may include links to other sites on the Internet that are owned and operated by online merchants and other third parties. You acknowledge that we are not responsible for the availability of, or the content located on or through, any third-party site. Our website is operated and provided in the State of New York. As such, we are subject to the laws of the State of New York, and such laws will govern this Terms of Use, without giving effect to any choice of law rules. Visitor assumes all knowledge of applicable law and is responsible for compliance with any such laws. 12. Botnets
Academy of Personal Training Education retains the right, at our sole discretion, to terminate any accounts involved with botnets and related activities. If any hostnames are used as command and control points for botnets, Academy of Personal Training Education reserves the right to direct the involved hostnames to a honeypot, loopback address, logging facility, or any other destination at our discretion.
13. Other Terms
If any provision of this Terms of Use Agreement shall be unlawful, void or unenforceable for any reason, the other provisions (and any partially-enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent. You agree that this Terms of Use Agreement and any other agreements referenced herein may be assigned by Academy of Personal Training Education, in our sole discretion, to a third party in the event of a merger or acquisition. This Terms of Use Agreement shall apply in addition to, and shall not be superseded by, any other written agreement between us in relation to your participation as a Visitor. Visitor agrees that by accepting this Terms of Use Agreement, Visitor is consenting to the use and disclosure of their personally identifiable information and other practices described in our Privacy Policy Statement.
14. Course Registration Policies
Registration Cancellation
APTE has a No – Refund Policy. Notice of cancellation and rescheduling requests received twenty-four (24) hours before a course will be eligible for a tuition credit, less a fifteen (15%) cancellation fee.
There are no refunds or credits for CPR-AED Courses, Home Study, Pre-recorded, or Virtual (ZOOM) courses.
Courses marker with an Asterix * have a 50% cancellation fee.
APTE Face-to-Face Course Cancellation
APTE may provide notification of cancellation as late as six (6:00 a.m.) the day of the event for courses starting @ nine (9:00) AM and as late as three (3) hours before the start time of an afternoon or evening course. Courses canceled due to weather or unforeseen circumstances will be rescheduled. Students will receive notice of the rescheduled class as soon as possible. Cancellation information will be posted and announced on one or all of the following:

Unforeseen Circumstances
In the case of institution closures, pandemics, or any other unforeseen circumstance, APTE reserves the right to provide the course in a virtual format. Courses stated as providing “hands-on” practical skill training will be rescheduled for a later date.
Lateness and Early Departure Policy for Continuing Education Courses
There is a fifteen (15) minute grace period. After the first fifteen (15) minutes and each additional quarter-hour, 0.1875 credits will be deducted from the total credit value of the course based on credits issued per hour.
Virtual Webinars
If a technology, power, or system fails, the event will be rescheduled within 72 hours of the initial date. There is a no refund policy for rescheduled events.
Virtual
All attendees must have a working camera to attend a virtual course. Cameras are required to be on. Any socially inappropriate behavior or comment will instantly warrant the registrant’s removal from the course.
Payment Plan Option PPO
Courses paid using the payment plan option have a no-refund policy. Payments are as follows:
The first payment is upon registration. The balance and a $20 administrative fee will be billed to a credit card ten (10) days before the course starts.
Practical Hands-On Participation – Release Waiver
I (The registrant, attendee, and student) understand that I am responsible for monitoring my exercise abilities during hands-on skill learning and assume the risk of participating in such exercises. I further agree to hold harmless APTE, its affiliates, and its staff members conducting the program from any claims, suits, losses, or related cause of action for damages during or arising in any way from the program.
